1. Purpose
This Anti-Spam & Marketing Policy outlines Digicounted LTD’s (“Digicounted,” “we,” “our,” or “us”) commitment to responsible marketing and compliance with laws governing electronic communications, including the UK Privacy and Electronic Communications Regulations (PECR) and UK GDPR.
Our goal is to ensure that all promotional and informational messages sent through the Digicounted platform or by our resellers are lawful, permission-based, and respectful of recipients’ privacy.
2. What Constitutes Spam
“Spam” refers to any unsolicited bulk or mass communication sent via email, SMS, chat, or social media to recipients who have not given explicit consent to receive such messages.
Spam includes but is not limited to:
Unauthorised commercial emails or texts.
Cold outreach using purchased, rented, or scraped contact lists.
Misleading subject lines or deceptive message content.
Excessive messaging that disrupts user experience.
Digicounted strictly prohibits the sending of any form of spam through its systems or by its resellers.
3. Acceptable Marketing Practices
Resellers and affiliates must:
Obtain clear, verifiable consent before sending promotional messages.
Provide an obvious and functional unsubscribe link or opt-out mechanism in every message.
Identify themselves clearly as the sender and include accurate contact details.
Use honest subject lines and avoid misleading or exaggerated claims.
Keep records of consent (opt-in forms, timestamp, IP address, or source).
Honour unsubscribe or opt-out requests within 48 hours.
4. Platform Use and Automation
When using Digicounted’s marketing or automation tools, users must:
Use only approved contact lists gathered through legitimate, opt-in sources.
Refrain from sending campaigns to contacts imported without consent.
Comply with DigiCounted's acceptable-use standards and all applicable data-protection regulations.
Avoid sending messages that violate the CAP Code or the Consumer Protection from Unfair Trading Regulations 2008.
Failure to follow these rules may lead to immediate suspension or termination of platform access.
5. Monitoring and Enforcement
Digicounted actively monitors outgoing marketing activity for abuse signals such as high bounce rates, spam complaints, or blacklisted IP addresses.
We reserve the right to:
Pause or review campaigns that show suspicious patterns.
Suspend accounts engaged in spam or non-compliant marketing.
Report serious violations to relevant authorities or email-service providers.
Repeated or intentional violations will result in permanent removal from the reseller programme and forfeiture of pending commissions.
6. Third-Party Marketing Integrations
If you connect external marketing tools (such as Mailgun, Twilio, Facebook, or WhatsApp integrations), you must also comply with those providers’ anti-spam policies.
You are fully responsible for ensuring your usage remains compliant with their terms.
7. Compliance Responsibility
Each reseller or affiliate acts as an independent data controller for their own marketing activities. It is your responsibility to understand and comply with all applicable marketing and data-protection laws in your region.
Digicounted provides training and templates as guidance only and does not assume legal responsibility for your communications.
8. Reporting Abuse
If you receive any message that appears to originate from Digicounted or one of its resellers and believe it to be spam or misleading, please forward it with full headers to:

9. Consequences of Violation
